Further to MC No. 3735 issued on December 27, 2022, we wish to remind all clearing participants that checks with alphanumeric issue date will remain acceptable until April 30, 2023. 2. We also would like to clarify that the intention of the full numeric date format (MM-DD-YYYY) is to implement a standard for writing the issue date on the Check as after cutoff date, said standard shall become part of determining Check acceptability for clearing. 3. For banks generating computer printed Checks for their customers, please revise attendant check printing applications in order to comply with the MM-DD-YYYY issue date format before the May 1, 2023 cutover date. The same should be advised to clients who were permitted by the bank to print their own computer-generated Checks. 4. Starting May 1, 2023, a Check on which the issue date is written in alphanumeric format will no longer be accepted except when – a) it is among the Checks described under Section 2.2 of OM No. 21-036, which are as follows: 1. Post-Dated Checks (PDCs) accepted/stamped 'Warehoused' by banks prior to May 2, 2023; 2. PDCs without 'Warehoused' stamp but bearing or printed with 'Unique Identification Code' (UIC) that indicates receipt by banks (for warehousing) prior to February 11, 2019 (date of issuance of CICS OM No. 19-030); or 3. Manager's Check/Cashier's Check issued by the clearing banks bearing the Waiver Statement and features required prior to the issuance of CICS OM No. 19-030; b) it is dated on or before April 30, 2023 and presented to the Presenting Bank for deposit prior to the 180th day from its issue date. 5. Moreover, we wish to make it clear that computer generated/printed Checks on which date figures/numbers in MM-DD-YYYY format appear to be printed outside, above or below the appropriate individual boxes, shall continue to be acceptable UNLESS the numbers encroach other fields rendering such date unreadable. 6. Further to CICS OM No. 21-036 dated April 16, 2021, we wish to remind all clearing participants that May 2, 2023 is the cutover date for the implementation of the new Check Design Standards and Specifications. 2. Aside from those already mentioned in CICS Operating Memo No. 19-030 dated February 11, 2019, the new Check design shall include the following changes: 2.1. Standard Month-Day-Year format (MM-DD-YYYY), with the date format guide below the dateline and a box for each of the MM-DD-YYYY characters. 2.2. The Peso (₱) sign is excluded (moved out) from the box where the Amount in Figures will be written (Peso sign placed before the box). 2.3. Boxed Signature/s Line 3. December 22, 2022 T O : All Member/Participant Banks R E : RETENTION OF ORIGINAL CHECKS THAT ARE PAID/HONORED 1. This Operating Memo serves as a reminder to all Clearing Participants to observe the provisions of Section 12 of the CICS Rules and Regulations (Retention of Original Checks that are Paid/Honored) as well as the attendant implementing (updated) guidelines defined in CICS Operating Memo (OM) No. 18-029 dated December 18, 2018. 2. As Presenting Banks have the option to outsource/entrust the safekeeping of these paid/honored original checks to either a designated storage company or to the respective clients of banks offering mobile check deposits, it is incumbent upon each Depository/Presenting Bank to make sure that: 2.1. it will be able to provide to the Drawee Bank the physical original check (POC) that was paid/honored upon the latter’s request for any of the following reasons/purposes : 2.1.1. Litigation Court Order 2.1.2. Fraud Investigation 2.1.3. Validation of Duplicate or Counterfeit Check/Item; and 2.2. the prescribed turnaround period (15 days) is strictly observed for retrieval of the POC from the client/storage facility. 3. In case of failure of the Presenting Bank to present to the Drawee Bank the paid Original Check within the period provided in the stated CICS Operating Memo, the paid Original Check is conclusively presumed to - 3.1. be a Duplicate or Counterfeit or with Alteration or Technical Defects; or 3.2. have been fraudulently endorsed or have no authorized endorsement when such endorsement is necessary; or 3.3. its presentment for clearing is in violation of any of the warranties of the Presenting Bank under Section 16.3 of the CICSS RR; as the case may be (depending on the reason/s or basis cited by the Drawee Bank in its request to obtain/see the Original Check), so that the Drawee Bank is entitled to demand reimbursement from the Presenting Bank of the amount of the Check via the usual Charge Slip. 4. Acceptance of the Charge Slip by the Presenting Bank is mandatory. 5. If the Presenting Bank maintains that its reimbursement of the amount of the Check (on the basis of its mandatory acceptance of the Drawee Bank’s Charge Slip) is unjustified, it may pursue an action in Court (and not through the facilities or arbitration mechanism of PCHC) against the Drawee Bank for recovery of said amount under the general principles of law. 6.
