March 13, 2023 TO: All Clearing Banks/Institutions RE: CLARIFICATION ON THE ISSUANCE OF CICS OM NO. 23-041 1. We wish to clarify that CICS Operating Memo (OM) No. 23-041, dated March 8, 2023, was issued primarily to update CICS OM No. 17-012, dated February 14, 2017. 2. Similar to CICS OM No. 17-012 which covered auto-returned items, CICS OM No. 23-041 is intended to provide a workaround re-presentment procedure for a Presenting Bank to avail of when it receives now a rejection report of "Item already presented" which, however, turns out to be referring to a False Duplicate Item. 3. For purposes of this Memo, a False Duplicate Item is a Regular Clearing Item captured in a Presenting Bank's Frontend system and transmitted to CICS and flagged by the system to be an "Item already presented" due to the similarity of its Electronic Payment Information (PI) to the EPI of another item earlier stored in the archive facility of the CICS Backend. It could be that the earlier-transmitted/archived item shows an inadvertently misread/erroneous check number making the newly/subsequently presented item appear to be a duplicate. 3.1. Prior to AWS Cloud migration, automated validation of duplicate items happened locally at the PBM servers of the participant banks. Thus, two or more items bearing similar Check Number, Drawee BRSTN and Drawee Account Number could be transmitted separately from different PBM servers and be received successfully in CICS. When these similar items were received at the Drawee Bank's PBM server - with duplicate checking process in effect, similar items received after the first were auto-returned within the 4- day duplicate validation period. CICS OM No. 17-012 then effectively provided the work-around process for any auto-returned item that was actually a False Duplicate Item, that is, 2nd presentment via a Charge Slip. 3.2. After the AWS Cloud migration, IC file validation is now done centrally and as a result, an item received at the CICS Backend that shows similar EPI to one that is already in the CICS archive, will be rejected by the system (i.e., without intervention of the Drawee Bank) citing the reason: "Item already presented." Since the False Duplicate Item will surely be rejected again if re-presented, sending it as re-clearing on first presentment will allow for another presentment in case it is returned for a reason that allows re-clearing; hence, the need for the issuance of CICS OM No. 23-041 to update the operating procedure to handle False Duplicate Items. 3.3. With the Presenting Bank prevented from re-presenting a False Duplicate Item, its use of a re-clearing procedure on first presentment as work-around technically provides an opportunity for a second presentment in case of technical or funding issues that still allow re-presentment. Thus, CICS OM No. 23- 041 provides the use of Charge Slip for the 2nd presentment. 4. While these operating memos provide handling procedures for duplicate items, they are primarily aimed at addressing False Duplicate Items with the work-around in order to complete their transmission and/or re- presentment. 5. On the other hand, CICS OM Nos. 20-033 and 21-037 pertain to Settlement Procedures in a multiple presentment scenario where a Drawee Bank seeks reimbursement for financial loss due to double/multiple payments which, incidentally, occurred a number of times prior to the AWS Cloud migration as only a 4-day duplicate detection was then available. 6. We trust we have clearly differentiated the work-around procedures (under CICS OM Nos. 17-012 & 23-041 to complete a transmission of a False Duplicate Item) from the settlement procedures (under OM Nos. 20-033 & 21- 037 for the recovery by the Drawee Bank of financial losses resulting from multiple presentments of clearing items).

March 08, 2023 To: All Clearing Participation Banks/Institutions Re: HANDLING OF DUPLICATE ITEMS DETECTED BY THE CICS BACKEND 1. The CICS Migration to the AWS Cloud on November 7, 2022 has effectively extended the period of detection of duplicate transactions from 4 days to 180 days. 2. With the central validation now done at the CICS Backend, all inward Regular Clearing Items showing similar Electronic Payment Information or MICR Information (EPI/MICR Information): i.e., Check number and Drawee Bank's BRSTN and Drawer's account number, are rejected by the clearing system with the reason: "Item already presented" for the information of the Presenting Bank. 3. While the 180-day period of duplicate detection effectively blocks the processing of clearing items representing Duplicate Checks, a CICS Backend report of "Item already presented" may not always be indicative of presentment of a Duplicate Check as, at times, such a report could be the result of misreads of the Presenting Bank's CICS Frontend of the EPI/MIC Information on a Check earlier presented or currently processed, giving rise to a "False Duplicate Item". 4. False Duplicate Items pose presentment issues to the Presenting Banks considering that there is a limitation set by the rules on the number of times a check is allowed to be re-presented or re-cleared, as provided in Section 21.1 of the Check Image Clearing System Rules and Regulations (CICSRR) which says that - "21.1. A returned Check may be presented again for clearing as a CICS Item. Such Check can be re-cleared only once thru the original Presenting Clearing Branch/Unit or the branch of account and under the same depository account." and 5. To provide a work around procedure and to address this issue in case a Regular Clearing Item is rejected during transmission for the reason: "Item already presented", the Presenting Bank shall: 5.1. login to the web portal (https:\\cpacsweb.pchc.com.ph) and search if an item in the CICS Archive with the same EPI/MICR Information as that of the rejected Regular Clearing Item exists; 5.1.1. if an identical outward item is found, the Presenting Bank shall validate further if the Regular Clearing Item being presented/rejected represents- 5.1.1.1. an item it previously transmitted, then the item should no longer be retransmitted as it represents an item that had already been successfully transmitted previously from another PBM of the Presenting Bank; or 5.1.1.2. a re-clearing item that was not tagged as such (presentment value is still 0) in the CICS front end, then batch it again as an item for re-clearing in the CICS Frontend and re-transmit; or 5.1.1.3. a valid re-clearing item tagged as re-clearing on its initial presentment to enable transmission of a False Duplicate Item, then refer to item 6.2.1 below to handle its re-clearing. 5.1.2. if no identical outward item is found in the CICS Archive despite the CICS Backend report of "Item already presented", call the Head Office/Central Clearing of the Drawee Bank and inquire if said item information exists. 6. Verification by the Drawee Bank of an "Item already presented" can be performed by searching in the web portal (https:\\cpacsweb.pchc.com.ph) the item covered by the Presenting Bank's inquiry for it to confirm whether or not the subject item is a False Duplicate item. 6.1. If the Drawee Bank responds to the inquiring Presenting Bank that the rejected Regular Clearing Item is a true Duplicate Item (since a clearing item with identical Check Image and/or EPI/MIC Information had already been presented or is being presented) the relevant Original Check (i.e., the physical Check deposited with the Presenting Bank) may be returned by the Presenting Bank to the depositor if custody of such check is not explicitly requested by the Drawee Bank, cancelling the deposit transaction; 6.2. If the Drawee Bank responds to the inquiring Presenting Bank that the rejected Regular Clearing Item is a False Duplicate Item, the Presenting Bank may transmit for re-clearing the rejected Regular Clearing Item using a Re-Clearing Batch as a workaround. 6.2.1. After the successful transmission of a False Duplicate Item as re-clearing, should it be dishonored due to funding issues (i.e., DAI), for instance, representment of the item, if requested by the Depositor, should be made by the Presenting Bank by sending a Charge Slip (i.e., should not be as part of Re-Clearing Batch) because system limitation prevents further representment of the item even if the return reason allows representment. 6.2.1.1. Details of the Charge Slip should indicate the following information: "Presentment of an item initially transmitted using re-clearing batch on (date of initial presentment) due to a False Duplicate detection." 7. The affected Presenting Bank may get from the Drawee Bank the relative information on the Presenting Bank that misread the EPI/MIC Information on the relevant Check and impose an inconvenience fee against the erring Presenting Bank via charge slip. The fee to be collected shall be the amount of the item multiplied by the average IBCL rate for the day (minimum of Php1,000.00). 8. This supersedes OM No. 17-012 dated February 14, 2017. 9. Inward Regular Clearing Items that show identical Check Image and Electronic Payment Information (Check number, Drawee Bank's BRSTN, Drawer's account number) is indicative of duplicate or multiple presentments of a Check or the existence of a Duplicate Check or Counterfeit Check as these terms are defined in items 16 and 20, respectively, of Section 2 of the CICS Rules and Regulations in which case Sections 18 and 19 and related issuances shall apply for its/ their handling. 10. Please be guided accordingly.
