    July 30, 2024   TO          :              All   Clearing Participant Banks/Institutions RE          :              RE-CLEARING OF DISHONORED ITEMS QUALIFIED FOR REPRESENTMENT                                                                                                                                                                                                            1.      Section 21 of the CICS Rules and Regulations (CICS RR) permits a returned Check/Regular Clearing Item (RCI) to be re-cleared once thru the Original Presenting Bank Branch/Unit or the branch of account and under the same depository account provided the reason of its dishonor allows representment.      2.      Stated in the same Section is the responsibility of the Presenting Bank to affix a 2nd Presentment Stamp when the RCI is sent for reclearing, with concomitant penalty on said Bank in case of its   failure to do so.   3.   With the increasing number of banks embracing mobile check deposit and adopting efficient processing technologies for outgoing items, there is a need to update Section 21.2 of the CICS RR to allow the digital imposition of a 2nd Presentment Stamp/print to indicate to the Drawee Bank that the RCI is being sent for re- clearing.  As such, Section 21.2 is amended to read as follows:   “A returned Regular Clearing Item presented for re-clearing shall be manually affixed with a 2nd Presentment stamp as shown below or imposed a digital printing of the words ‘2nd Presentment’ at the dorsal image of the Check.   “Failure of the Presenting Bank to manually affix or digitally impose or print the words ‘2nd Presentment’ shall subject it to a fixed penalty of P200.00 per item to be collected by the Drawe Bank.”   4.   We trust that the foregoing amendment/changes would streamline the re-clearing process.   5.      For information and guidance.

    July 23, 2024   T O        :              All Clearing Banks / Institutions   R E        :              CLARIFICATION ON ADVISORIES AGAINST ACCEPTANCE OF CHECKS/ CUSTOMER-GENERATED CHECK IMAGES BEARING IRREGULARITES IN THEIR FRONT AND/OR DORSAL DEPOSIT INFORMATION (FDI/DDI)     1.        We would like to clarify that the following PCHC issuances:   MC/OM No. Issued on Title MC 3514 Feb. 19, 2019 Caution on Duplicate Presentment of Checks MC 3616 Aug 10, 2020 Reminder on the Non-acceptance of Checks with Erasures, Alterations and/or Duplicate Account Number Written at their Corresponding Dorsal Sides OM 24-047 June 28, 2024 Measures to Prevent Multiple Presentment of Checks   have been intended to caution banks offering mobile deposit facilities (“MDF Banks”) against accepting for mobile deposit Customer-generated Check Images with irregularities in their FDIs/DDIs as these irregularities could be indicative of earlier presentments and payments that could give rise to reimbursement claims against the Drawee Banks and, in turn, recovery claims against the Presenting Banks.  Thus, acceptance for mobile deposit of Customer-generated Check Images bearing any or all of the following FDI/DDI irregularities:                                              1.1.     erasure or alteration on : a)     the name of the depository bank (the “ Depository Bank ”); b)     account number of the deposit account to which the proceeds of the clearing item will be credited (the “ Account Number ”); c)     the date of deposit (the “ Deposit Date ”) and on d)     the endorsement of the Payee/depositor (the “ Endorsement ”)           1.2.     indication of two or more Depository Banks, and/or Account Numbers, and/or Deposit Dates  ( whether with or without erasure/alteration/cancellation line ), or   1.3.    the name of the Depository Bank and/or the Deposit Date is different  from the actual Presenting Bank and/or actual Deposit Date;           is discouraged.   2.        It may happen, however, that a Check with the required DDI ( as specified in MC Nos. 3514 and 3616 ) or FDI (as required starting January 1, 2025 per CICS OM 24-047)  already written on it may not get to be deposited with the indicated Depository Bank, whether due to scanning/capturing problem or other reasons, so that the Payee may decide to deposit the Check through the mobile facility of another MDF or via the Over-the-Counter (OTC) facility of another bank.  In such a case, erasures/alterations will necessarily be done on the FDI/DDI of the Check giving rise to irregularities either on the Customer-generated Check Image transmitted to the alternative MDF Bank or alterations on the Check itself to be deposited over the counter of another bank.   3.        Whether –   3.1.      a Customer-generated Check Image with FDI/DDI irregularities, or 3.2.      a physical check with erased/cancelled FDI/DDI,     is to be accepted for clearing/deposit by another MDF Bank or another Depository Bank is entirely up to the discretion of the bank to which item 3.1 or item 3.2 above is presented.  The accepting MDF Bank/Depository Bank takes the risk on possible duplicate/multiple presentments of said clearing item that may render it liable to reimburse the Drawee Bank all amount/s paid in excess of the relevant Check’s indicated amount.    4.        In the event that (a) a Customer-generated Check Image with FDI/DDI irregularities or (b) a physical Check with erased/cancelled FDI/DDI (the “ Irregular/Cancelled FDI/DDI ”) gets accepted by another MDF Bank/ Depository Bank and transmitted for clearing to the Drawee Bank as a Regular Clearing Item (RCI), the following rules apply:   4.1.      An RCI with Irregular/Cancelled FDI/DDI should NOT be automatically dishonored by the Drawee Bank since it is the Presenting Bank of that RCI which shall bear the loss arising from duplicate/multiple payments on the relevant Check, except where the Drawee Bank honors the RCI notwithstanding its receipt of a PCHC MIS generated report/ICL file where the RCI is indicated as having been presented/paid earlier (the “ Duplicate Transaction Report ”), i.e. the RCI is listed/tagged  as a duplicate transaction in said file , in which case the Drawee Bank bears such loss despite  any Irregular/Cancelled FDI/DDI shown on the RCI, subject however to the provisions of Section 4.2 below.   4.1.1.  If no Duplicate Transaction Report is received by the Drawee Bank on the RCI with Irregular/Cancelled FDI/DDI, the Presenting Bank shall be liable to reimburse the Drawee Bank, upon demand, for all excess payment/s made on the relevant Check.   4.2.      The Drawee Bank shall not be entitled to recover from the Presenting Bank  any  loss occurring under the circumstances mentioned in Section 4.1 above (i.e., where the Drawee Bank honors the RCI despite it bearing Irregular/Cancelled FDI/DDI) except  where -   4.2.1.      the duplicate/multiple presentments of the RCI/s in question are transmitted by one and the same Presenting Bank in which case, it shall reimburse the Drawee Bank the amounts of the second or more payments on the Check – for breach by the Presenting Bank of its warranty under Section 16.3.c of the CICS RR; and/or   4.2.2.      the duplicate/multiple payments are made on Counterfeit Check/s in which case the Presenting Bank of the Counterfeit Check shall be liable to reimburse the Drawee Bank for the full amount of the Check – for breach of its warranty under Section 16.3.e of the CICS RR, provided however that if the relevant RCI shows irregularity/ies on its MICR code line or other details that should be noticed by the Drawee Bank in the normal course of its verification, the Drawee Bank shall be entitled to claim for reimbursement for only 50% of the amount of the Counterfeit Check.   4.3.     If the Drawee Bank dishonors an RCI and returns the same within the Prescribed Period to the Presenting Bank, it shall cite the appropriate return reason, to wit:   4.3.1.      Return Reason Code “I” for “Previously Negotiated/Paid Check” sent by   same Presenting Bank, as provided in Section 18 ( Regular Returns Clearing: Dishonor of Deposited Checks ): Subsection 18.1, item 29 of CICS RR; or   4.3.2.      Return Reason Code “S”  for “Duplicate Items detected by CICS” Backend but not previously paid to same Presenting Bank.                  5.    We would like to add that in cases where the Drawee Bank is entitled to claim reimbursement from the Presenting Bank/s for duplicate/multiple payment/s of a Check, it has the option to file with PCHC a written report with notification that it is seeking a reimbursement, whether or not there is any Irregular/Cancelled FDI/DDI shown on the relevant RCI.   6.        Please be guided accordingly.

    July 10, 2024   T O      :               All Clearing Banks/Institutions   R E         :               DUPLICATE ITEM TAG IN THE CICS  IMAGE CASH LETTER  (ICL) FILE     1.        In the meeting with the COCI Board and some invited  Clearing Officers last May 30, 2024, there was a suggestion/request to include in the CICS backend system a flag that would enable drawee banks to know and/or extract duplicate items before the 4:30 PM settlement cut-off time so that such exception can be promptly addressed and/or acted upon accordingly.   2.      To address this request/requirement, a duplicate indicator has been defined in one of the fields in the ICL file structure such that during the CICS backend validation process, the field shall be tagged to identify duplicate items before the generation and delivery of various inward ICLs intended for the different drawee banks.   3.    Specifically, Field 17 has been introduced in the Check Detail Record (Type 25) of the ICL file. If an item is identified as a duplicate, this field will contain a value of “1”; otherwise, it remains blank.   4.      Drawee banks can at their own volition, automate the identification of duplicate items by incorporating this new field into their respective CICS Front-end systems through its inward ICL validation process. Alternatively, banks can inquire about duplicate items information through the CICS Web Portal by selecting this field as one of their search criteria.   5.     Consequently, the PBM Technical Specifications document Version 1.11 has been updated to Version 1.12. This revision included the details about the new field in the ICL file specifications section. Interested banks may download the updated PBM document from the documents section of the CICS Web Portal in the UAT environment.   6.       The Enquiry module of the CICS Web Portal has also been enhanced to include the new field as one of the search criteria in the Enquiry Module.   7.      PCHC has already deployed these changes in the UAT environment so that participants may start to explore this new feature.   8.       For information and guidance.

    July 02, 2024   T O        :               All Clearing Banks/Institutions   R E          :               REMINDER ON WRITING INFORMATION ON CHECKS FOR DEPOSIT/CLEARING     1.      We have been receiving requests for clarifications regarding different issuances as well as incidents on the non- acceptance of Checks citing reasons that are not listed in any of the published memo circulars of PCHC.   2.      With the implementation of the New Check Design effective May 1, 2024, we once again wish to  clarify and remind observance of the following guidelines in writing information on Checks for deposit/clearing :   2.1.   Relevant information   2.1.1.  The Issue date  – the date to be indicated on the Check must be purely numeric MM-DD-YYYY, with dash (“-“) as the only allowed partition symbol. The use of any other symbols to separate the month from the day and the day from the year will render the Check unacceptable for deposit/clearing starting January 2, 2025 when the moratorium for not conforming to the acceptable standard/ format is lifted.     Acceptable Format: Not Acceptable starting January 2, 2025: Examples of wrong writing of date, or with unacceptable partition/format. 2.1.2.    The Amount in Figures  – the amount to be indicated inside the amount box should be a standard number where centavos are separated by a period (.), the hundreds from thousands by a comma (,), thousands from millions by a comma, so on and so forth. The numbers in the amount box should not include any symbols before and after to enable accurate character amount recognition. Examples:   Acceptable:   Not acceptable starting January 2, 2025   2.1.3.  The Payee  – except for payment intended for Government Agencies like BIR/BOC where “Payee” name may include additional text like, “FAO Bureau of Internal Revenue…”, the payee line may indicate the name of a person, entity, or “Cash”. While there is no prohibition in adding any symbols before and after the payee name to deter attempt to alter/change the name of the payee, the combination of ‘Person Name and Cash’, ‘Person Name and/or Cash’, ‘Business Name or Cash’, and ‘Business Name and/or Cash’ is considered a Technical Defect and as such, not acceptable for deposit/clearing. Examples:   Acceptable:   2.1.4.  The Amount in Words  – The Amount in Words is a must for a Check to be acceptable for deposit/clearing.  There are no restrictions regarding symbols traditionally placed before and after he Amount in Words to deter attempts for alteration.  Examples:   Whole Amount (no centavos): Without the word “Only” for whole amount (no centavos) does not render the Check unacceptable for deposit/clearing.   Amount with centavos:   2.1.5.  The Signature/s  – the presence of drawer’s signature validates the Check issued as regular and negotiable. Two signatories may share one signature box and signatures that exceeds the box boundaries do not affect the Check’s acceptability for deposit/clearing.   2.2.   Conditions where Old Format Checks are still acceptable for deposit/clearing   2.2.1.  Post-dated old format Checks when issued and submitted by the Payee to the Depository Bank for warehousing before May 1, 2024. These Checks were stamped, “Warehoused” by the depository bank and deposited to the Payee Account when due.   2.2.2.  Bank-Issued old format Checks like Managers’/Cashiers/Gift Checks, Demand Drafts, provided that:   2.2.2.1.     the issue date is in the acceptable format, i.e. MM-DD-YYY, MM-D-YYYY, or M- DD-YYYY (with dash as the only allowed partition symbol); and    2.2.2.2.     there are no special characters or symbols added before or after the Amount in Figures   2.3.   Circumstances where an issued Check should be refused acceptance when deposited:   2.3.1.  It is technically defective , i.e. post-dated, stale-dated, no amount in words, no signature, paid to a named person/entity and/or cash, altered, with erasures, or a portion of the payment information is unreadable (torn or covered with ink).   2.3.1.1.  Checks with technical defects may be returned by the Drawee within the prescribed period and collects penalty pursuant to Section 3 of CICS OM No. 17- 019 dated September 13, 2017.   2.3.1.2.   Technically defective Checks if inadvertently accepted for deposit and paid, may be returned by the Drawee Bank using a Charge Slip within a period of three (3) years from date of clearing (Without penalty if returned beyond the prescribed period. Acceptance by the Presenting Bank is mandatory).   2.3.2.  Old format Checks  which are not bank-issued, nor warehoused before May 1, 2024 (date of issue is on or after May 1, 2024). This could include Demand Drafts.   2.3.3.  Checks detected as duplicate when inquired via Decision Support Platform (manually or via API), upon deposit via Mobile Deposit Facility (MDF) and/or Checks detected or seen to be Counterfeits.   3.      We highly recommend that you share the aforementioned information/reminder with all your offices/branches to ensure its dissemination to all customers who write/issue Checks.   4.      For your information and guidance.
