December 12, 2024 TO : All Clearing Banks/Institutions RE : INDICATING FRONT DEPOSIT INFORMATION ON CHECKS FOR MOBILE DEPOSIT 1. In reference to MC No. 3851 dated November 15, 2024, which extended the mandatory implementation of the Front Deposit Information (FDI) indication on the face of the Check, we would like to provide you with an update. 2. Considering the substantial amount of time required to ensure widespread customer awareness, we have decided to grant an additional extension specifically for banks offering the Mobile Deposit Facility (MDF). 3. As such, implementation date shall be deferred further from February 1, 2025 to April 1, 2025. This extension allows MDF banks ample time to prepare and educate their customers about the new FDI requirement. 4. However, we would like to emphasize that MDF banks have the flexibility to proceed with the implementation of FDI prior to April 1, 2025 if they are fully prepared and ready to do so. We encourage banks to prioritize customer education and awareness to ensure a smooth transition to the new FDI indication on checks. 5. November 20, 2024 T O : All Clearing Banks/Institutions R E : NON ACCEPTANCE OF CHECKS WITH NON ESSENTIAL SPECIAL CHARACTERS OR SYMBOLS/MARKS OR WITH UNNECESSARY DETAILS 1. We refer to Memo Circular (MC) No. 3814 dated 03 June 2024 where PCHC announced the extension of a moratorium to another six months in allowing the acceptance of checks with non-essential characters or symbols written on them. 2. It may be recalled that after this announcement, PCHC had released MC #3821 dated 02 July 2024 illustrating how the guidelines in writing information on checks should be performed by the respective customers of participating banks/institutions. 3. As we approach the year ending 2024, we would like to get feedback from the participants before we implement the above subject. Though we expect that proper dissemination/customer awareness or campaigns on the guidelines have been made during the moratorium period, the readiness of the great majority is important to us. 4. November 15, 2024 TO : ALL CLEARING PARTICIPANTS WITH MOBILE DEPOSIT FACILITY RE : INDICATING/WRITING OF FDI ON CHECKS FOR MOBILE DEPOSITS Relative to CICS OM No. 24-047 dated June 28, 2024 where we stated that the front deposit information or FDI for mobile check deposits should appear on the space between the Account Name and the Payee line (as illustrated below), please be informed that implementation has been deferred to February 1, 2025. This one-month extension is in response to requests received from banks offering mobile deposit facilities on account of the IT freeze preventing them from performing any system changes during season. June 28, 2024 TO : All Clearing Participant Banks/Institutions RE : MEASURES TO PREVENT MULTIPLE PRESENTMENTS OF CHECKS 1. On the basis of actual cases of multiple Check deposits referred to us by participant banks offering Mobile Deposit Facility (the ” MDF Banks ”), and taking into account the views expressed in our consultation/discussion with the Board members of the Clearing Officers Club, Inc. (COCI) as well as the inputs gathered in a separate discussion with the representatives of MDF Banks, we believe the interest of MDF Banks would be served better if each Customer-generated Check Image they receive for a mobile Check deposit shows the following: 1.1. a Front Deposit Information (FDI) on the face of the relevant Customer-generated Check Image consisting of : 1.1.1. its abbreviated name (i.e., the “ MDF/Depository Bank ”), and 1.1.2. the Account number in the MDF/Depository bank to which the Check clearing proceeds are to be credited (i.e., the “ Depository Account No. ”); and 1.2. a Dorsal Deposit Information (DDI) at the back of the relevant Customer-generated Check Image it receives , consisting of: 1.2.1. the Date of Presentation for Deposit 1.2.2. the Signature/Endorsement of the Depositor/Payee . 2. The FDI should appear on the space between the Account Name and the Payee line as shown below: 3. The MDF/Depository Bank should ascertain that the word “ COPY ” does not appear at the right outermost portion of the Customer-generated Check Image received (as shown in the sample Check above); otherwise, the deposit should not be accepted. 4. The changes announced here are viewed as improvements to the requirements published/circularized in Memo Circular 3514 issued on February 19, 2019 where the Depository Account No. was made part of the Dorsal Deposit Information (DDI) . With the changes, Depositors/Payees will henceforth need only to write the DDI details specified in Section 1.2 above. As attempts to defraud are increasing, these new requirements are looked upon as more effective in deterring fraudulent mobile check deposits. 5. The FDI and DDI specified in Sections 1.1 and 1.2 should be shown on Customer-generated Check Images presented to MDFs starting January 1, 2025. This cutover/implementation date is deemed to give ample time for MDF Banks to cascade to their respective clients the – 5.1. need to write on each Check to be deposited via MDF the FDI and DDI specified above ; and 5.2. the advice/information that in case of unsuccessful capture or failed transmission of a mobile check deposit to the MDF/Depository Bank, the Original Check (which would then bear the specified FDI and DDI) can be presented over the counter of the MDF/Depository Bank. The MDF shall accept the deposit of the Original Check over its counter provided that it is the MDF/Depository Bank in the FDI and it is certain that no prior presentment was made by it and that no earlier payment on it was received by it from the Drawee Bank. 6. Multiple presentments of Checks for clearing necessarily result in receipt by the Drawee Banks of Duplicate clearing items. More controls therefore are needed to curtail duplicate/multiple presentments of Checks. Considering the risk of double/multiple presentments/payments of a Check, PCHC deems it necessary to require/mandate MDF Banks to make use of the Decision Support Platform (DSP) in their mobile deposit processing. This platform has been made available since September 18, 2023. 7. The DSP is an additional layer of control that allows banks to validate whether a Check has been previously presented or has been marked for presentation by a member bank. The solution has been successfully piloted and is now being used by Union Bank in their MDF operation. 8. As there is a need to develop APIs on the side of the banks offering MDF for automated access to the DSP, we are setting the cutover/implementation date for the compulsory use of the DSP to March 1, 2025. In the meantime, we strongly encourage MDF Banks to obtain the API specs from PCHC’s technical team. 9. We count on your full support and cooperation as PCHC continues to explore on finding means to assist its participating banks in preventing potential frauds. 10. October 23, 2024 TO : All Clearing Participant Banks/Institutions RE : UPDATED GUIDELINES ON THE RETENTION OF PAID PHYSICAL ORIGINAL CHECKS AND DRAWEE BANK’S REQUEST FOR RETRIEVAL 1. Section12 of the CICS Rules and Regulations (CICS RR) states that the Presenting Bank should keep the Physical Original Checks that are paid or honored (the “ Paid POC ”) for a period of one hundred-eighty (180) days from the date of clearing settlement (the “ Retention Period ”). Presenting Banks may opt to outsource the safekeeping of the Paid POC to a storage service company of its choice. 2. For banks offering mobile deposit facility (the “ MDF Banks ”), however, they have the option of entrusting the custodianship of Paid POCs to the respective Depositors (the “ Mobile Check Depositors” ). If the MDF Banks take that option, they have to require their Mobile Check Depositors to: 2.1. keep the Paid POC/s within the Retention Period; and to 2.2. turn over the Paid POC/s to the depository MDF Bank whenever required within the Retention Period; in line with the custodianship requirement under Section 12 of the CICS Rules and Regulations, the MDF Banks are expected to provide in their deposit agreements the said obligations of the Mobile Check Depositors. 3. For ease of identification and fast retrieval, the Paid POCs must be bundled/wrapped and labelled with the following details: 3.1. BRSTN of the Presenting Bank Branch 3.2. Transaction Date unless in the case of safekeeping by a storage provider, the said provider prescribes its own standard labelling for easy retrieval, in which case it has to be complied with by the Presenting Banks before they entrust custody of the paid POCs to the respective providers. 4. Within the Retention Period, a Drawee Bank may request the Presenting Bank/depository MDF Bank to turn over to it the Paid POC/s (the “ Retrieval Request ” ) specified in its request for the following reasons: 4.1. Litigation Court Order 4.2. Fraud Investigation 4.3. Examination of Paid POC/s claimed by Drawee Bank’s Client/Account Holder (the “ Accountholder ”) to – 4.3.1. be Duplicate/s or be Counterfeit/s of the POC/s; or 4.3.2. bear Alteration/s and/or Forged/Unauthorized Endorsement/s or to bear forged signature/s of Accountholder/s 5. The Retrieval Request shall be conveyed to the Presenting Bank/depository MDF Bank via a formal letter of request substantially in the format shown in Annex A (the “ Retrieval Request Letter ”), copy furnished PCHC, stating the following information: 5.1. Purpose or Nature of the request 5.2. Date of Presentation/Trasaction Date 5.3. Check and Account Numbers 5.4. Drawee Bank Branch Name and/or BRSTN 5.5. Amount 5.6. Presenting Bank Branch Name and/or BRSTN 6. The Retrieval Request Letter should be signed by the Drawee Bank’s authorized signatory. 7. The standard turnaround period for a Retrieval Request is hereby extended to allow reasonable time in consideration of the distance/accessibility of the branch/storage provider from the bank’s nearest branch, or if the presenting bank is a digital bank which has no physical branch, to wit: 7.1. Presenting and Drawee Bank Branches are located within the same region The Presenting Bank/depository MDF Bank is given seven (7) working days to respond and inform the requesting Drawee Bank cc: PCHC, on the status of the request. PCHC shall not entertain any query or complaint regarding request for a Paid POC if it is not furnished any prior communication regarding the request. 7.1.1. If as of date of receipt by the Presenting Bank of the Retrieval Request Letter the requested Paid POC had already been submitted to an outsourced storage provider, the Presenting Bank is given additional seven (7) working days from date of receipt of the Letter from the Drawee Bank to make available the retrieved Paid POC to the requesting Drawee Bank, making the total number of allowable days to be fourteen (14). 7.2. Either of the Parties are located in different regions (i.e. Cebu and GMA) Presenting Bank has a total of twenty (20) working days from receipt of the Retrieval Request Letter of the Drawee Bank to make available the retrieved Paid POC. Presenting Bank may request additional period for the POC’s availability based on the retrieval period advised by the outsourced storage provider if requested item had already been submitted for safekeeping. 8. The Presenting Bank/depository MDF Bank shall advise the Drawee Bank of the requested Paid POC’s availability attaching its Authority to Retrieve from the concerned Presenting Bank Branch. The requesting Drawee Bank may arrange for pick-up of the retrieved Paid POC after it is advised by the Presenting Bank/depository MDF Bank of the availability. 9. The requesting Drawee Bank shall automatically become the new custodian of the retrieved Paid POC for the remaining days within the relevant Retention Period, hence, the need for it to formally acknowledge receipt/possession of the requested Paid POC from the Presenting Bank/depository MDF Bank. 10. In case of failure of the Presenting Bank/depository MDF Bank to produce the requested Paid POC within the Retention Period, the Presenting Bank shall: 10.1. pay PCHC the amount of One Thousand Pesos (₱1,000.00) as penalty for violation of Section 12 of the CICS RR which shall be collected by PCHC via Charge Slip; and 10.2. be answerable to the Drawee Bank for such liabilities as provided or warranted under applicable laws and the CICS Rules and Regulations as well as its Operating Guidelines. 11.
